The Attorney for the Child (AFC) Unit is passionately committed to the care and safeguarding of our community’s children. No part of our society is more in need of guidance through the often bewildering and confusing experience of the legal system as the young. Our AFC Attorneys put all of their experience, knowledge and compassion into the service of youths facing these difficult situations. It is our sincere belief that a child should not be left alone to sort out problems which even adults can find overwhelming. We strive to provide a steady hand to young people so that they may come through these ordeals able to live rich and full lives.
The AFC Unit represents children in Monroe County Family Court. These attorneys, formerly known as Law Guardians, are appointed by the court to provide free legal representation to children in a variety of cases, including:
- Abuse
- Custody
- Foster Care
- Juvenile Delinquency
- Person In Need Of Supervision (PINS)
Who qualifies for an appointment of an Attorney for the Child?
All children from birth to 21 years old who are parties to or the subject of a Family Court Petition.
How does a child obtain an Attorney for the Child?
An Attorney for the Child is appointed by an order of a Family Court Judge to represent children who are appearing in proceedings before them.
Who does the Attorney for the Child represent?
The Attorney for the Child is the child's lawyer and will advocate for what the child requests. The wishes and feelings of the child are the primary concern of the Attorney for the Child.
Who pays for an Attorney for the Child?
This AFC Unit is funded by the New York State Office of Court Administration. The services of our highly qualified attorneys and advocates are provided at no cost to our clients.
